That’s right, I said it.

7. SOTOMAYOR ON ABORTION, GAY MARRIAGE: Sotomayor’s record on two key hot button cultural issues is thin. But, quite notably, her sole opinion regarding abortion was in line with the anti-abortion movement’s position. Some details from the anti-abortion site LifeNews.com:

“Despite 17 years on the bench, Judge Sotomayor has never directly decided whether a law regulating abortion was constitutional,” the pro-life group Americans United for Life noted in a recent analysis of potential Supreme Court candidates.

Sotomayor participated in a decision concerning the Mexico City Policy, which President Obama recently overturned and which prohibits sending taxpayer dollars to groups that promote and perform abortions in other nations.

Writing for the Second Circuit, Judge Sotomayor upheld the Mexico City Policy, but AUL says the significance of the decision “may be minimal because the issue was largely controlled by the Second Circuit’s earlier opinion in a similar challenge to the policy.”

AUL notes that Judge Sotomayor also upheld the pro-life policy by rejecting claims from a pro-abortion legal group that it violated the Equal Protection Clause.

BUT OMG IT’S OKAY, CAUSE LOOK AT #9:

9. SOTOMAYOR “SAVED BASEBALL”: “During a brief period in 1995,” the New York Times reported, “Judge Sonia Sotomayor became revered, at least in those cities with major league baseball teams. She ended a long baseball strike that year, briskly ruling against the owners in favor of the players.” A bit more:

The owners were trying to subvert the labor system, she said, and the strike had “placed the entire concept of collective bargaining on trial.”

After play resumed, The Philadelphia Inquirer wrote that by saving the season, Judge Sotomayor joined forever the ranks of Joe DiMaggio, Willie Mays, Jackie Robinson and Ted Williams. The Chicago Sun-Times said she “delivered a wicked fastball” to baseball owners and emerged as one of the most inspiring figures in the history of the sport.

Because, certainly, as a sexually active woman who is her child-bearing years and sexually active with a member of the opposite sex, fucking BASEBALL should be a more pressing issue to me than my constitutionally protected right to a fucking abortion. The last challenges to Roe were decided by ONE VOTE MAJORITIES (pro-Roe, obvs). This isn’t a chance I am willing to fucking take.

But it’s cool though, because you see what Obama did? He totally ushered in an era of HOPE and CHANGE!

    I basically understand your opposition to Sotomayor, but I don't really think it's that substantive. The opinions she has published are brilliant, and she understands what it takes for an American to work your way up from the bottom. First, Judge Sotomayor's lack of record on hot issues is part of what will get her confirmed. Yes, it's political, but conservatives have not been able to find much to attack her about, excpet for a few random quotes over the years. A judge with a long and clear pro choice or pro gay marriage record would be a detriment to the confirmation process. Additioanlly, the first Hispanic on the high court is a mjaor step in actually holding the Democratic party accountable for its promises to include the hispanic community in the political process.

    You should know (if you already didn't) that I'm probably just about as pro-choice as you can get, but I know that there's a good number of Americans out there who feel very differently. I do trust Sotomayor to protect decisions such as Roe, but I also expect her to compromise on issues that are more specific – even regarding abortion – that may conflict with my opinion. She will be a great Justice once confirmed in July, and be an ally to the Left.

    I will admit, I don't really understand the third party thing, but you shouldn't bite off your nose to spite your face. I know us Democrats and President Obama are not quite running things how you would ideally like, but we are a 2 two party country, and the Democratic party has done an amazing job over the past 5 months at balancing the interests of all americans while still pursuing a democratic agenda.

    I don't know where to start.

    2 party country, hmm? Is that what it's come to? If you're not on one side, you're automatically on the other? That's why you don't understand the "third party thing". There are other options outside of Republicrat and Democan.

    Roe was a faulty decision- and a greatly misunderstood one- but it's as simple as the 10th Amendment. Read it, and you'll see that a lot of the "decisions" made by the Supremes are in fact incorrect. I fail to see how the Constitution invested the Supremes with the authority to overrule state law in the instance of abortion. Right to privacy? What right to privacy? You may claim it, but it's not in there, and there's no way you or anyone else can convince me that it's some kind of invasion of privacy to decide the legality of an abortion.

    Before you flame away, I should probably inform you that I am pro-choice. I just know the difference between what federal law should (and shouldn't!) do and state's rights.

    "Ally to the Left", you say? What ever happened to confirming a justice who did her job, regardless of who she "allies" with or benefits? Isn't that the whole idea? Her political affiliation is NOT RELEVANT.

    Again, who cares if she's female, hispanic, purple, orange, asexual, it doesn't matter and does not relate at all to her ability to perform her duties if she were confirmed. Yet again, a "qualification" that is NOT RELEVANT.

    Ryan is a veritable saint of politics. This partisan bullshit is the contemporary curse of America. If we divide ourselves into the hemispheres of right and left, and if we concentrate on all the ways in which we differ, we will make decisions based more on the basis of our deviations from one another and less on the basis of what is moral, just, and correct.

    Fuck any and all mention of race, gender, party alignment, and economic circumstances. They are all, as Ryan has said, grossly irrelevant.
